AIDS 2008 : Pétition internationale contre la criminalisation de la transmission du VIH

Nous nous autorisons à relancer cette brève peut-être passée inaperçue sur OSI Bouaké en cette période estivale, car force est de constater que cette pétition pourtant fondamentale reste en déshérence de signatures (84 signataires en deux semaines). La voici en version française :

Lors de la conférence sur le sida   à Mexico, Act Up-Paris a lancé une pétition internationale contre la criminalisation de la transmission du VIH  . Vous trouverez ci-dessous le texte de cette pétition en français. Nous vous invitons à le signer ici.

Le consensus qui est ressorti de la conférence est celui d’une opposition à la pénalisation. Il faut profiter de cette occasion pour que TOUS et TOUTES les acteurs/rices de la lutte contre le sida  , séropositifVEs, activistes, médecins, chercheurSEs, etc. manifestent aussi leur opposition.

Texte :

Act Up-Paris apporte son soutien au Juge Edwin Cameron (Afrique du Sud), qui lors de la dernière session plénière de la conférence internationale sur le sida   de Mexico a fait un discours brillant contre la criminalisation.

Nous lançons aujourd’hui une pétition internationale contre la pénalisation de la transmission du VIH  .

À travers tous les pays du monde, face à toutes les législations, nous demandons l’abrogation totale et définitive de toutes les lois spécifiques visant à punir les personnes séropositives lors de la transmission du VIH   .

Dans les pays où la transmission du VIH   ne constitue pas une infraction spécifique, et où toutefois des condamnations sont prononcées, nous demandons que les plaintes soient classées sans suite et que les procureurEs cessent de requérir des peines à l’encontre des séropositifVEs et qu’ils/elles comprennent que de telles sentences font le jeu de l’épidémie.

Nous demandons que les peines des prisonnierEs séropositifVES condamnéEs pour avoir transmis le VIH   soient annulées.

Nous demandons aux bailleurs de fond, notamment, Fonds Global, PEPFAR  , l’Union Européenne, la Fondation Bill et Melinda Gates, de porter une attention particulière aux programmes qu’ils financent, pour ne pas soutenir de façon indirecte des législations discriminatoires.

Nous voulons faire admettre le principe que le sida   ne doit en aucun cas être un facteur aggravant lors d’une procédure judiciaire.

Nous séropositifVEs, actrices et acteurs de la lutte contre le sida  , associations de lutte contre le sida  , nous faisons front commun : NI COUPABLE, NI VICTIME, nous combatterons ensemble dans nos pays respectifs et dans les différentes instances internationales contre les discours, les lois, les jurisprudences menant à faire des séroposifVEs les boucs émissaires, portant la responsabilité de l’épidémie.

Cette pétition a recueilli de nombreuses signatures de participants à la conférence, parmi lesquelles celles du Pr. Michel Kazatchkine, the Executive Director of the Global Fund against HIV/AIDS, Tuberculosis and Malaria, Pr. Willy Rozenbaum, the President of the French National AIDS Council on AIDS, Dr. Bruno Spire, the President of AIDES, the primary French non governmental HIV/AIDS organisation, Mike Kennedy, the Secretary of Australian Federation of AIDS Organisations.

Juge Edwin Cameron, openly HIVpositive member of the South African Supreme Court of Appeal, made a brilliant speech against criminalization of HIV transmission and calls for international mobilization.

Act Up-Paris supports this call and preceeded it by launching a international initiative : the « International petition against criminalization of HIV transmission » on Monday 5th of August.

In this petition, our statement :

demands the complete and definitive abrogation, in every country, of every law that aims specifically at punishing HIV positive men and women for the transmission of HIV ;
in the countries where no specific laws exist but where HIV positive people are however sentenced by courts for having transmitted HIV, demands that prosecutors understand that such sentencing won’t stop the pandemic, and either stop taking HIV transmission cases, or refrain from requesting prison or damages against people living with HIV ;
demands that the prison sentences pronounced against HIV positive persons for having transmitted HIV be cancelled ;
calls upon AIDS major funders, and especially the Global Fund, PEPFAR  , the European Union and the Bill and Melinda Gates Foundation, to pay special attention to what programs they finance, with a view to ensuring that the programs they support are not embedded in legislations that criminalize, even indirectly, either HIV status or HIV transmission ;
demands that courts and legal experts around the world recognize the legal human rights principle that courts must never make their sentence harsher on the mere basis that the person convicted happens to be HIV positive. Act Up-Paris called the people involved in the fight against AIDS and AIDS organizations, stand united « Neither guilty nor victims » and fight together in their respective countries and at an international level against the representations, the laws, and the court decisions that lead to make scapegoats out of people living with HIV, putting the responsibility for the pandemic solely on their shoulders.

This petition already got numerous signatures from the participants of the AIDS Confrence, including those of Pr. Michel Kazatchkine, the Executive Drector of the Global Fund against HIV/AIDS, Tuberculosis and Malaria, Pr. Willy Rozenbaum, the President of the French National AIDS Council on AIDS, Dr. Bruno Spire, the President of AIDES, the primary French non governmental HIV/AIDS organisation, Mike Kennedy, the Secretary of Australian Federation of AIDS Organisations.
